Form 8082, Notice of Inconsistent Treatment or Administrative Adjustment Request, is filed by a partner, S-corporation shareholder, or other pass-through investor when they report an item differently than it appears on the Schedule K-1 issued to them. It is also used to request an administrative adjustment to a previously filed partnership return. The form flags the discrepancy to the IRS rather than silently deviating from the entity-level reporting.
Investors in real-estate partnerships, fund vehicles, or jointly owned campground entities sometimes receive a K-1 they believe is wrong or that omits an item. Form 8082 is the formal way to take a different position while disclosing the inconsistency, which protects against penalties for unexplained mismatches. It also covers situations where a K-1 never arrives but the income or loss still must be reported.
